Terms of Service

1. Acceptance of Terms

By accessing or using YACHTCREST ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users, including private owners, brokers, and visitors.

2. Eligibility & Account Registration

You must be at least 18 years old and legally capable of entering into binding contracts to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. You are responsible for safeguarding your password and for all activity under your account.

3. Listings & User Content

Users may create listings for yachts offered for sale or charter. You are solely responsible for the accuracy, legality, and completeness of all content you submit, including descriptions, specifications, pricing, and images. YACHTCREST reserves the right to review, approve, reject, or remove any listing at its sole discretion.

You warrant that you have the legal right to advertise the vessel and that all information provided is truthful and not misleading. Prohibited content includes, but is not limited to, fraudulent listings, duplicate postings, stolen vessels, and content that infringes the intellectual property rights of others.

4. Subscriptions & Payments

Brokers and private owners may subscribe to paid plans to advertise listings on the Platform. Subscription fees are billed in advance on a monthly, quarterly, or yearly basis depending on the selected plan. All payments are processed securely through our payment provider, Stripe.

Prices are shown in euros and include any discount for the billing cycle you choose. The private owner plan includes a free first month; once it ends, the plan continues as a paid subscription only if you choose to subscribe. Payments by bank transfer, PayPal, or Worldpay become active once we confirm the payment has been received.

Automatic renewal. Card subscriptions renew automatically at the end of each billing period at the price then in force, and the payment method on file is charged. We will give at least 30 days' notice of any price change, and you may cancel before it takes effect.

Cancellation. You may cancel at any time from your dashboard or by contacting us. Cancellation stops future renewals; your plan and listings stay active until the end of the period already paid for, after which listings beyond the free allowance are hidden from search.

Refunds. Fees already paid for a billing period are non-refundable, except where required by law or where we cannot provide the service because of our own error. Where consumer law gives you a cooling-off period, you may cancel within 14 days of first subscribing for a refund, less a proportionate amount for any days the service was used.

Failed payments and downgrades. If a renewal payment fails, we may retry it and suspend paid features until it succeeds. If you downgrade or your plan expires, listings above the new limit will be paused. Listing limits and feature access correspond to the subscribed plan and may change with notice.

5. Verification & Badges

YACHTCREST offers optional verification for brokers and private owners. Verification is not an endorsement or guarantee of a user's legitimacy, the accuracy of their listings, or the condition of any vessel. Verification badges indicate only that certain documentation has been reviewed. YACHTCREST may revoke verification status at any time.

6. Transactions Between Users

YACHTCREST is a marketplace platform that facilitates connections between buyers, sellers, and charterers. We are not a party to any transaction between users and do not handle escrow, title transfers, or funds beyond subscription payments. Any transaction entered into is solely between the users involved, and YACHTCREST bears no responsibility for the outcome.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose;
• Post false, misleading, or fraudulent listings;
• Scrape, copy, or redistribute Platform content without authorisation;
• Interfere with or disrupt the Platform's servers or security;
• Impersonate another person or entity;
• Send unsolicited communications through the Platform's lead or inquiry features.

8. Intellectual Property

All Platform branding, design, text, and software are the property of YACHTCREST or its licensors and are protected by intellectual property laws. User-submitted content remains the property of the submitting user, who grants YACHTCREST a non-exclusive, royalty-free licence to display such content on the Platform for the purpose of operating and promoting the service.

9. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind. YACHTCREST does not guarantee that listings are accurate, that vessels are as described, or that the Platform will be uninterrupted or error-free. To the maximum extent permitted by law, YACHTCREST shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

10. Termination

You may close your account at any time. YACHTCREST may suspend or terminate your access to the Platform at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Platform ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
